Software Lizenzvereinbarung für Easy Audio Copy
WICHTIG- BITTE SORGFÄLTIG LESEN: DURCH DAS INSTALLIEREN DER SOFTWARE (WIE UNTEN DEFINIERT), KOPIEREN DER SOFTWARE
UND/ODER DAS DRÜCKEN DER UNTENSTEHENDEN "JA"-SCHALTFLÄCHE, SIND SIE (ENTWEDER SIE SELBST ODER EINE JURISTISCHE PERSON)
MIT ALLEN BESTIMMUNGEN DIESER ENDBENUTZER-LIZENZVEREINBARUNG ("VEREINBARUNG") BEZÜGLICH IHRER NUTZUNG DER SOFTWARE
EINVERSTANDEN. FALLS SIE NICHT ALLEN BESTIMMUNGEN DIESER VEREINBARUNG ZUSTIMMEN, DRÜCKEN SIE DIE "NEIN" SCHALTFLÄCHE
UND/ODER INSTALLIEREN, KOPIEREN UND/ODER NUTZEN SIE DIE SOFTWARE NICHT.
1. LIZENZERTEILUNG: Vorbehaltlich der untenstehenden Bedingungen, erteilt Ihnen Andre Wiethoff ("Firma") hiermit eine nicht-exklusive, nicht-übertragbare
Lizenz um die Downloadversion von Easy Audio Copy ("Software") zu installieren und zu nutzen.
Sie lizensieren die Software nur für nicht-kommerzielle Nutzung. Ihre Lizenz ist kostenlos. Sie dürfen: (i) Die Software auf einem einzigen Rechner für Ihre
privaten, internen Zwecke installieren und nutzen, und in keinem Fall für den Vorteil einer Firma oder einer gewinnorientierten juristischen Person; und (ii) die
Software für Backup oder Archivierungszwecke kopieren.
Egal ob Sie die Software als Individuum oder als eine juristische Person lizensieren, dürfen Sie nicht: (i) Reverse Engineering der Software durchführen, die
Software decompilieren oder disassemblieren; (ii) die Software ändern oder abgeleitete Werke basierend auf dieser erstellen, weder im Ganzen noch teilweise;
(iii) ohne vorherige Erlaubnis Kopien der Software verteilen; (iv) irgendwelche Eigentumshinweise oder Beschriftungen entfernen oder ändern; oder (v) die
Software wiederverkaufen, verpachten, vermieten, übertragen, unterlizensieren, oder anderweitig die Rechte an der Software übertragen ohne vorherige
Genehmigung.
Ihnen ist nicht erlaubt die Software auf folgenden Geräten zu installieren: (i) jedes dedizierte Gerät, welches als Desktop oder Laptop Computer mit einem
Microsoft Windows Betriebssystem konfiguriert wurde, aber den Einsatz eines Benutzers auf einen speziellen Zweck einschränkt und diesem dadurch die
Multifunktionsfähigkeit nimmt; und (ii) jedes Gerät welches nicht in der Lage ist übliche Büroverwaltungssoftware gleichzeitig mit anderen Programmen
ablaufen zu lassen.
Die Software greift auf verschiedene Internet-basierende Dienste automatisch zu, ohne den Nutzer vorher darüber zu befragen. Die Internet-basierten Dienste
können jederzeit (i) aufhören Daten zu liefern, oder (ii) ihre Lizenz für die Software beenden. Dies ist kein Fehler, und stellt auch keinen Garantiefall dar.
Der Einsatz der Software ist gedacht, um legal erworbene Audio CDs zu konvertieren bzw. ein Backup davon zu erstellen. Easy Audio Copy darf nicht dazu
benutzt werden um illegale Kopien von urheberrechtlich geschützten oder kopiergeschützten Werken herzustellen.
2. EIGENTUMSRECHTE: Sie erkennen an, dass kein Anspruch auf das geistige Eigentum auf Sie übertragen wird. Rechtsanspruch, Eigentum, Rechte, und
geistiges Eigentum auf und an der Software verbleiben bei der Firma. Die Software ist durch das deutsche Urheberrecht und internationale Abkommen
geschützt.
3. UPDATES: Von Zeit zu Zeit wird die Firma kostenlose Updates der Software zur Verfügung stellen, welche üblicherweise existierende Fehler der Software
beseitigen. Alle Updates der Software werden durch dieses Abkommen reglementiert, es sei denn, dass anderslautende Lizenzpassagen mit dem Update
ausgeliefert werden. Die Firma reserviert sich das Recht jegliche bestehende Funktion in einem zukünftigen Update zu entfernen.
5. MP3 LIZENZ: MPEG Layer-3 Audio Kodierungstechnologie wurde lizensiert von Fraunhofer IIS und Thomson Licensing.
Die Beschaffung dieses Produktes überträgt keine Lizenz und beinhaltet auch kein Recht um mit diesem Programm erzeugte, konforme MP3 Layer-3 Inhalte
über Einnahmen-generierende Sendungssysteme (Antenne, Satellit, Kabel und/oder andere Vertriebskanäle), Streaming-Anwendungen (über Internet,
Intranetze und/oder andere Netzwerke), andere Inhaltsverteilsysteme (Pay-Audio oder Audio-OnDemand Anwendungen und ähnliches) oder auf physischen
Medien (Compact Discs, Digital Versatile Discs, Halbleiterchips, Festplatten, Speicherkarten und ähnliches) zu verbreiten.

6. GEWÄHRLEISTUNGSAUSSCHLUSS:
SIE STIMMEN ZU, DASS DIE FIRMA IHNEN KEINE AUSDRÜCKLICHEN GARANTIEN BEZÜGLICH DER NUTZUNG ODER LEISTUNG, WEDER MÜNDLICH
NOCH SCHRIFTLICH, BEZÜGLICH DES PRODUKTES ZUGESICHERT HAT UND DASS DIE PRODUKTE "WIE VORHANDEN" BEREITGESTELLT
WERDEN, OHNE GARANTIEN JEGLICHER ART. DIE FIRMA GEWÄHRT KEINE GARANTIEN, BEDINGUNGEN, ERKLÄRUNGEN ODER BESTIMMUNGEN
(AUSDRÜCKLICH ODER STILLSCHWEIGEND, SEI ES DURCH EINE GESETZGEBUNG, GELTENDES RECHT, GEWOHNHEITSRECHT, VERWENDUNG
ODER EIN SONSTIGES RECHT) IN BEZUG AUF JEDE ANGELEGENHEIT, EINSCHLIESSLICH, JEDOCH NICHT BESCHRÄNKT AUF NICHTVERLETZUNG

7. HAFTUNGSBESCHRÄNKUNG: Sie übernehmen das volle Risiko der Programmbenutzung.
IN DEM NACH GELTENDEN GESETZEN HÖCHSTMÖGLICHEN ZULÄSSIGEM UMFANG HAFTET DIE FIRMA IHNEN GEGENÜBER ODER GEGENÜBER
SONSTIGEN PERSONEN NICHT FÜR SCHÄDEN UND FOLGESCHÄDEN AUS ENTGANGENEM GEWINN, ODER AUF SCHADENSERSATZ AUFGRUND
VON FAHRLÄSSIGKEIT JEGLICHER ART, INSBESONDERE SCHADENSERSATZ FÜR DATENVERLUST, ARBEITSUNTERBRECHUNG, AUSFALL ODER
FEHLFUNKTION VON COMPUTERN ODER FÜR IRGENDWELCHE SONSTIGEN SCHÄDEN ODER VERLUSTE. IN KEINEM FALL HAFTET DIE FIRMA FÜR
SCHÄDEN, DIE DAS VON IHNEN BEZAHLTE ENTGELT ÜBERSTEIGEN, SELBST WENN DIE FIRMA AUF DIE MÖGLICHKEIT DERARTIGER SCHÄDEN
HINGEWIESEN WURDE.
8. BEENDIGUNG: Dieses Abkommen beendet sich automatisch, falls Sie die in diesem Abkommen beschriebenen Einschränkungen nicht einhalten, oder falls
Sie entscheiden die Lizenz nach Ablauf der Testperiode nicht weiter zu verwenden. Es benötigt keine Mitteilung der Firma um eine solche Beendigung in Kraft
treten zu lassen. Bei einer Beendigung müssen Sie alle Kopien der Software deinstallieren und zerstören.
9. VERSCHIEDENES:
Salvatorische Klausel.
Falls sich eine Klausel in diesem Vertrag als unwirksam oder nicht durchsetzbar herausstellen sollte, berührt dies nicht die Wirksamkeit der anderen
Vertragsklauseln, die gemäß ihrer Bedingungen gültig und durchsetzbar bleiben. Eine nicht durchsetzbare Klausel soll so umgestaltet werden wie es ihrer
Intention entspricht, aber vor Gericht durchsetzbar ist.
Export.
Sie sind einverstanden die Software nicht außerhalb der Jurisdiktion zu exportieren oder zu re-exportieren, in welcher Sie diese erhalten haben, ohne deutsche
oder ausländische Regierungslizenzen zu besitzen.
Geltendes Recht und Gerichtsstand.
Diese Vereinbarung untersteht den Gesetzen Deutschlands und wird komplett in Deutschland ausgeführt. Der Gerichtsstand befindet sich in Deutschland.
Dieser Vertrag unterliegt nicht dem Übereinkommen der Vereinten Nationen für Verträge über den internationalen Verkauf von Waren, deren Anwendung
hiermit ausdrücklich ausgeschlossen wird.
Vollständige Vereinbarung.
Sie stimmen zu, dass diese Vereinbarung die vollständige Regelung sämtlicher Vereinbarungen zwischen Ihnen und der Firma darstellt, schriftlich oder in
anderen Kommunikationsformen, und allen anderen Absprachen zwischen Ihnen und der Firma in Bezug auf den Inhalt vorgeht.
Vorbehaltene Rechte.
Alle in diesem Lizenzvertrag nicht ausdrücklich gewährten Rechte sind der Firma vorbehalten.

Diese Software enthält Bibliotheken und ausführbare Programme welche freie Software sind; Sie dürfen diese Bibliotheken bzw. ausführbaren Programme
